General Sarath Fonseka arrested by Military police

8 Feb 2010

Rtd. General Sarath Fonseka has been arrested and court martialed by the Sri Lanka Army for committing military offences, Military Spokesman told. His media secretary Senaka de Silva was also arrested.

The arrest was confirmed by the Military spokesperson Maj: Gen: Prasad Samarasinghe.
Plotting a coup to topple the government, plotting to assassinate the President Mahinda Rajapaksa, keeping Army officers illegally, revealing Military secrets are some of the many confirmed chargers on Rtd. Gen: Sarath Fonseka, stated Mr. Lakshman Hulugalle, the Director General of Media Center for National Security (MCNS).
Mr. Fonseka had unsuccessfully contested last month’s presidential elections allied with LTTE proxy TNA, Marxist JVP and capitalist UNP where Mahinda Rajapaksa was the overwhelming winner.

Earlier in the evening, the BBC carried the following report:

Sri Lanka’s former military commander says that he is prepared to give evidence in an international court on war crime charges against Sri Lanka. General Sarath Fonseka speaking to journalists in Colomboon Monday said, “I am not going to save anyone who has committed war crimes”.
"I am definitely going to reveal what I know, what I was told and what I heard. Any one who has committed war crimes should definitely be brought into courts," Gen. Fonseka said.

Update (Feb 10)
Addressing the media briefing held today at the Media Center for National Security, Defence Spokesman Keheliya Rambukwella said the former Army Commander was arrested Monday for violating the 57(1) clause of the Army Act.

The Spokesman said the military police are conducting inquiries into General Fonseka's alleged connections and dealings of political nature while being a member of the national Security Council which is the most powerful body in charge of national security.

Any Army officer or soldier after resigning or retiring from the Army, is bound by the Army Act for a period of six months, the Defence Spokesman added.

Answering a question the Military Spokesman said any one guilty in a Court Martial has the right to appeal against the verdict in the Court of Appeal and finally in the Supreme Court. The Military Spokesman said General Fonseka is not hindered from exercising all his constitutional rights and he has access to his lawyer and family. He may nominate his own lawyer, the Spokesman said.
